Terms & Conditions
These Terms & Conditions constitute a legally binding agreement between El
Yellow House and the Client.
Definitions
In these Terms & Conditions:
• “El Yellow House”, “the Studio”, “we”, “us”, and “our” refer to El Yellow House.
• “The Client” refers to the individual or entity making the booking and all persons attending the Studio under that booking.Agreement
By signing this document, making a booking, or entering the Studio, the Client agrees to be bound by these Terms & Conditions and confirms they have authority to accept them on behalf of all attendees.Studio Hire
• The Studio is hired as a partially equipped creative space.
• Hire time includes access, setup, use, and vacating the Studio.
• The Studio may only be used for lawful professional photography, filming, or approved creative production.
• The Client is solely responsible for the conduct and actions of all persons attending under their booking.Booking & Payment
• A booking is only confirmed once full payment has been received, unless otherwise agreed in writing.
• The Studio reserves the right to refuse access where payment has not been received.
• Late arrival or early departure does not affect the agreed hire period or fees.Cancellation & Amendments
5.1 Booking Confirmation & Payment:
• All bookings are confirmed only upon receipt of full payment.
• All payments are subject to the cancellation and rescheduling terms set out below.
5.2 Notice Requirements & Refunds:
• All cancellation or rescheduling requests must be made in writing.
IMPORTANT NOTICE PERIOD RULES
• 1 week’s notice or more: Full refund or free rescheduling.
• 48 hours’ notice: 50% refund or rescheduling with 50% of the booking fee retained.
• 24 hours’ notice or less: No refund. Rescheduling may be offered at the Studio’s discretion with a 25% discount applied to a future booking.
5.3 Bookings Made Within 48 Hours:
• Any booking made for use of the Studio within a 48-hour timeframe is non-refundable in the event of cancellation or rescheduling.
5.4 Rebooking & Slot Reallocation:
• Where notice of cancellation or rescheduling is given, the Studio will make reasonable efforts to rebook the cancelled slot.
• If the Studio is able to fully rebook the slot, a full or partial refund may be issued at the Studio’s discretion.
• If the slot cannot be rebooked, the Studio reserves the right to retain the applicable portion of the booking fee in accordance with the notice periods above.
5.5 Studio Cancellation:
• The Studio reserves the right to cancel a booking due to circumstances beyond its reasonable control.
• In such cases, liability shall be strictly limited to a refund of fees paid.Use of Space
• The Client must not alter, damage, or interfere with the Studio, fixtures, or facilities unless written consent granted.
• The use of liquids, body paint, smoke, fire, hazardous materials, adhesives, or special effects is prohibited unless expressly approved in writing.
• The Studio must be vacated in the condition it was provided, fair wear and tear excepted.Equipment & Competence
• Any equipment or facilities provided by the Studio are used at the Client’s own risk.
• The Client warrants that they and their crew are competent to operate professional photographic and filming equipment.
• The Studio provides no technical supervision or instruction unless expressly agreed in writing.Damage, Loss & Charges
• The Client is fully liable for any loss, damage, or excessive cleaning required as a result of the hire.
• Charges will be applied at full repair or replacement cost.
• Normal wear and tear is excluded.Health & Safety
• The Client must comply with all applicable health and safety laws and Studio instructions.
• Fire exits must remain clear at all times.
• The Studio reserves the right to suspend or terminate any activity deemed unsafe, without refund.Animals
• Animals are permitted only with prior written consent.
• The Client accepts full liability for any damage, injury, or cleaning resulting from animals.Overtime
• Use of the Studio beyond the booked period constitutes overtime and will be charged accordingly.
• Unauthorised overtime may result in additional charges or refusal of future bookings.Personal Property
• The Studio accepts no responsibility for loss, theft, or damage to personal property or equipment brought into the Studio.
• Forgotten items will be held at the studio for 2 weeks for collection.Conduct & Termination
• The Studio reserves the right to immediately terminate the hire without refund in the event of unsafe, unlawful, abusive, or inappropriate behaviour, or breach of these Terms & Conditions.Indemnity
• The Client shall indemnify and hold harmless the Studio, its owners,employees, and agents from all claims, losses, damages, costs, and liabilities arising from or in connection with the Client’s use of the Studio.Limitation of Liability
• To the fullest extent permitted by law, the Studio shall not be liable for any indirect, consequential, or economic loss. Total liability shall be limited to the fees paid for the hire, except where liability cannot be excluded by law.Insurance
• The Client is responsible for arranging any insurance required in connection with the hire, including public liability insurance.Intellectual Property & Content
• The Studio claims no ownership over content created by the Client.
• The Client warrants that all content created is lawful and does not infringe any third-party rights.Right to Refuse Future Bookings
• The Studio reserves the right to refuse future bookings at its sole discretion.Governing Law
• This Agreement is governed by the laws of England and Wales, and the parties submit to the exclusive jurisdiction of its courts.
